Max Pergola Limited Warranty

1. Warrantor and covered purchaser

Max Pergola warrants a new Max Pergola consumer product to the original retail purchaser for personal, family, or household use in the United States. The selling entity identified in the accepted order acts as the warrantor for that order. This limited warranty is not transferable. Coverage begins on the documented delivery date.

2. What this limited warranty covers

This limited warranty covers defects in materials or workmanship that arise under normal residential use during the applicable period:

• Ten years: aluminum columns, structural perimeter beams, and base plates.
• Five years: factory-applied powder coating against covered peeling, flaking, or adhesion failure. Gradual color or gloss change from ordinary outdoor exposure is not a covered defect.
• Two years: louver movement components, linkages, motors, control units, remotes, and Max Pergola-supplied LED electrical components included in the accepted order.

During the first year, Max Pergola will also pay standard freight to deliver an approved covered replacement part to the original U.S. delivery address. Expedited freight, diagnostic visits, access equipment, removal, reinstallation, electrician work, installer labor, finishing, permits, and other labor are not included unless the accepted order states otherwise.

3. What Max Pergola will do

After confirming a covered defect, Max Pergola will, at its option, repair the covered component, provide a new or functionally equivalent replacement component, or provide another remedy required by applicable law. Replacement parts may differ in color or appearance because coatings and products change over time. Any replacement does not restart the original warranty period; it remains covered for the balance of that period.

4. What is not covered

This limited warranty does not cover damage, failure, or deterioration caused by:

• improper transport, storage, site preparation, assembly, installation, anchoring, foundation work, wall attachment, wiring, drainage connection, maintenance, repair, or modification;
• failure to follow applicable instructions or approved project documents;
• abuse, misuse, impact, vandalism, falling objects, chemicals, incompatible cleaners, standing water, blocked drainage, or ordinary wear;
• corrosion from cuts, scratches, dissimilar metals, aggressive chemicals, coastal or industrial exposure not addressed in the accepted specification, or failure to maintain the finish;
• loads or events beyond the approved project design, including wind, snow, ice, flood, earthquake, fire, lightning, or foundation/soil movement;
• site conditions, anchors, fasteners, foundations, slabs, walls, electrical systems, or third-party products not supplied by Max Pergola; or
• minor dimensional, texture, gloss, or color variation within the accepted manufacturing standard.

5. How to obtain warranty service

Email inquiry@maxpergola.com with the purchaser name, order number, delivery date, affected SKU or part number, installation address, description of the issue, and clear photos or video. Keep the affected part and packaging when practical. Do not return, remove, alter, or repair a disputed component until Max Pergola provides instructions. Registration may speed service but is not a condition of warranty coverage.

6. Customer responsibilities

The customer must provide reasonable access to information needed to evaluate the claim and must protect the product from further damage. If inspection shows the issue is not covered, the customer is responsible for any agreed inspection, travel, shipping, repair, or replacement cost disclosed before the service occurs.

7. Implied warranties and state law

To the extent permitted by law, any implied warranty is limited to the duration of this limited written warranty. Some states do not allow limits on how long an implied warranty lasts, so that limit may not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so any applicable limitation may not apply to you.

This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state. Nothing in this warranty limits a remedy that cannot legally be limited.

8. Entire warranty and order-specific terms

This page is the pre-sale limited warranty for covered consumer products. An accepted order may identify the exact warrantor, product, components, commercial-use terms, or project-specific coverage. A change that reduces consumer coverage applies only when lawfully disclosed and agreed before purchase.
